Article 2 — Subject
This Pre-Information Form (the “Form”) has been prepared in accordance with Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (Official Gazette No. 29188), regarding the sale and delivery of the products whose qualities and sale price are stated below. This Form is an integral part of the Distance Sales Contract to be concluded between the parties and is intended to inform the Consumer (the “Buyer”).
Article 3 — Essential characteristics of the goods and payment information
The description, unit price, quantity and payment terms of the goods, services and products subject to sale are as stated at checkout and are confirmed by the Buyer. Shipping fees are payable by the Buyer.
Article 4 — Validity of commitments
The prices stated are the sale prices of the product. Prices and offers on the website are valid until updated or changed. Prices announced for a limited period are valid until the end of the stated period.
Article 5 — Delivery of products
- Products are delivered, packaged and intact together with their invoice, to the address indicated by the Buyer within 30 days of the order date at the latest. If the Seller fails to fulfil this obligation, the Buyer may terminate the contract.
- If products are to be delivered to a different person as stated by the Buyer, the Seller cannot be held responsible if that person/organisation refuses delivery.
- The Buyer is obliged to inspect the products upon receipt and to report any visible defects to the Seller immediately.
Article 6 — Right of withdrawal
For distance contracts on the sale of products, the Buyer may withdraw from the contract within 14 (fourteen) days from the date of delivery to the Buyer or the person/organisation at the indicated address, by rejecting the goods without assuming any legal or criminal liability and without giving any reason. Costs arising from the right of withdrawal are governed by the applicable regulation.
Article 7 — Products outside the right of withdrawal
Products prepared in line with the Buyer’s requests or personal needs, and other goods listed under the relevant regulation, are outside the scope of the right of withdrawal.
Article 8 — Dispute resolution
In disputes arising from this Form, Consumer Arbitration Committees and Consumer Courts in the Buyer’s and Seller’s place of residence have jurisdiction up to the limits announced annually by the Ministry of Trade.
